Welcome to 3QFitness.com (the “Site”), owned and operated by 3Q Fitness (“3Q Fitness,” “we,” “us,” “our”). By accessing the Site or participating in our programs, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

1) Who We Are

3Q Fitness is located in Garland, Texas and provides health and fitness coaching through group classes, specialty programs, and related services.

2) Eligibility

You must be 18 or older—or have parental/guardian consent—to register, purchase, or participate.

3) Memberships, Billing & Cancellations

• Memberships, passes, and packages are non-transferable and subject to the terms in your membership agreement or checkout page.
• Payments are processed by authorized third-party providers. You agree to provide accurate billing information and pay all charges when due.
• Cancellation, refund, no-show, and late-cancel policies are stated in your membership agreement and/or booking system and are incorporated by reference.

4) Health & Safety

Participation involves physical activity and inherent risks. By using our services, you acknowledge those risks and agree to participate responsibly, follow coach instructions, and consult a physician as needed.

5) Conduct & Acceptable Use

• Do not misuse the Site, interfere with its operation, attempt unauthorized access, or upload harmful content.
• Treat staff and members with respect; disruptive or unsafe behavior may result in suspension or termination of access.

6) Intellectual Property

The Site’s content (logos, images, text, videos, plans) is owned by 3Q Fitness or licensed to us and protected by law. You may not copy, distribute, or create derivative works without written permission.

7) Third-Party Services

We may link to or integrate third-party services (e.g., scheduling, payments, analytics). Their terms and privacy policies apply to your use of those services.

8) Disclaimer; Limitation of Liability

The Site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of any kind. 3Q Fitness is not liable for indirect, incidental, special, consequential, or punitive damages, and our total liability is limited to the greater of (a) amounts you paid to us in the 12 months prior to the claim or (b) $100, except where prohibited by law.

9) Indemnification

You agree to defend, indemnify, and hold harmless 3Q Fitness and our staff from claims arising out of your use of the Site or services, your violation of these Terms, or your infringement of third-party rights.

10) Changes to the Terms

We may update these Terms periodically. The latest version will be posted on this page with the “Last updated” date.

11) Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for disputes will be in appropriate state or federal courts located in Dallas County, Texas.

12) Contact

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
